[8] . ریشه های حمایت قانونی از حقوق مالکیت فکری در سطح ملی، به قرن 15 و 16 برمی گردد. زمانی که چندین کشور اروپایی قوانینی را برای حمایت از انواع خاصی از اموال فکری اختصاص داده بودند. در این راستا اولین قانون ثبت اختراع که به رسمیت شناخته شد، قانون 1474 ونیز بود که به اختراعات، یک دوره حمایت یک ساله اعطا می کرد؛ و اولین قانون کپی رایت، قانون انگلیسی «ان» مصوب  1709 بود. سایر کشورهای اروپایی نیز بعد از این در این زمینه اقداماتی انجام دادند و در پایان قرن 18 تعدادی از کشورها، قانون ثبت اختراع و قانون کپی رایت داشتند . ایالات متحده آمریکا نیز اولین قانون ثبت اختراع خود را در سال 1836 ارائه کرد.
